Overview
This course provides a comprehensive understanding of trust law and the role of trustees in the Isle of Man. Participants will explore the historical development of trust law, key legislation, types of trusts, and the duties and responsibilities of trustees. The course also addresses common challenges faced by trustees and best practices for effective trust management. Through practical examples, attendees will gain insights into real-world applications of trust law and trustee duties.
This course forms part of the 2025 ACSP CPD Programme.

Participants working in fund administration and corporate service administration with trustee administration responsibilities as well as individuals serving as trustees or considering take on trustee roles.

Session content
Introduction to Trust Law: Historical background and key legislation (Trusts Act 1995, Purpose Trusts Act 1996, Recognition of Trusts Act 1988).
Role and Duties of Trustees: Fiduciary duties (care, loyalty, impartiality) and administrative duties (record keeping, reporting, compliance, investment management).
Trustee Challenges and Best Practices: Managing conflicts of interest, regulatory compliance, effective communication, and continuous education.
Practical Examples: Practical examples of discretionary trusts, charitable trusts, and trusts facing regulatory challenges.

Heather-Anne Hubbell is a tax and risk specialist with an extensive legacy in financial services, strategic planning and governance who designs and delivers directors and company secretary training based on her experience as a director and company secretary and on working with global financial institutions and their directors’ responsibilities.
She has an LLB from Western Ontario and an LLM from Osgoode Hall Law School in Toronto.
